Sections 36, 37 and 38 of the Lotteries and Gaming Act, 2016 provide that the Board may establish a national register of gaming and betting machines and devices, determine and set standards in respect of the manufacture, supply, installation, adaption, maintenance or repair of gaming or betting machines and software.

Section 37 (3) provides that the Board may;

  1. Make arrangements with any person for the purpose of testing gaming or betting machines to ensure compliance with the required technical standards.
  2. Require the holder of a gaming or betting machine technical operating license to submit to a test and produce specific evidence of the result of the test.

Section 37(4) requires that for purpose of considering whether to grant an application for a gaming or betting machine operators license require the holder or an applicant for a gaming or betting machine technical operating license to submit a machine to a test in accordance with this section.

In addition, Regulation 7 of the Lotteries and Gaming (Gaming and Betting Machines) Regulations, S.1. No. 10 of 2017 provides that the Board may utilize the services of an independent testing laboratory approved by the Board for inspection and certification of any gaming or betting machine or device.

  1. PREQUALIFICATION OF INDEPENDENT TESTING LABORATORIES

Part iv of the Lotteries and Gaming (Gaming and Betting Machines) Regulations, S1. N0. 10 of 2017 provides for prequalification of independent gaming and betting machines testing laboratories. Regulation 13 states that a person who wishes to operate an independent gaming or betting machine testing laboratory or to inspect and recommend certification of any gaming or betting device for use in Uganda shall apply to the Board to be prequalified in Form 2 in the schedule hereby attached.

The objective of the prequalification is to test, certify and inspect casino equipment, gaming and betting software and slot machines (both hardware and software) for compliance with the law, regulations and standards.

  1. EXPERIENCE AND QUALIFICATION
  1. Minimum of 10 years in testing/inspections of gaming equipment. The applicant must submit proof of experience in these jurisdictions.
  2. Must own accredited testing laboratory (could be in Uganda or anywhere else in the world).
  3. Proof of technical capacity in terms of academic qualifications and experience of management and technicians employed by the applicant for prequalification as a testing laboratory.
  4. Must have ISO 17025 accreditation for general requirements for the competence of testing and calibration laboratories.
  5. Must have ISO720 accreditation for conformity assessment-requirements for the operation of various types of bodies performing inspection
  6. Must have ISO1765 accreditation for conformity assessment requirements for bodies that certify products, processes and services
  7. Applicant must have local representation in its ownership and management structures/agent/franchise.
  8. Applicant must have a physical location in Uganda.
